Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Last Command platform ("Service"), operated by Instance Labs LTD ("we", "us", "our"), a company registered in England and Wales.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. By creating an account, you represent and warrant that you are at least 16 years of age. If we learn that a user is under 16, we will terminate their account and delete their data.

If you are using the Service on behalf of an organisation (such as a gaming alliance or clan), you represent that you have the authority to bind that organisation to these Terms.

Last Command is a coordination platform for Last War: Survival alliances. The Service provides tools for organising events, tracking member activity, managing rosters, and analysing game performance data.

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

Last Command is an independent tool and is not affiliated with, endorsed by, or associated with Last War: Survival or its developer, FUNFLY PTE. LTD.

3.1 Registration

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.2 Account Security

You must notify us immediately at legal@instancelabs.dev if you believe your account has been compromised. We are not liable for losses caused by unauthorised use of your account where you have failed to safeguard your credentials.

3.3 One Account Per Person

Each person may only maintain one account. Creating multiple accounts to circumvent restrictions, bans, or usage limits is prohibited.

Alliances have a hierarchical rank system (R5 through R1). Alliance leaders (R5) and officers (R4) have elevated permissions, including the ability to manage members, edit settings, and view certain member data. By joining an alliance, you consent to officers exercising these management functions.

The R5 (leader) of an alliance is the sole person authorised to purchase, manage, or cancel a paid subscription for that alliance. Subscription decisions made by the R5 are binding on the alliance.

5.1 Plans

The Service offers a free tier and a paid Pro tier. The free tier provides core coordination features. The Pro tier unlocks additional capabilities including AI-powered screenshot scanning, advanced analytics, automated scheduling, and expanded event tracking. 5.2 Free Trial

Pro subscriptions include a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable fee.

5.3 Payment

All payments are processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis at the then-current subscription price. Prices are listed in your local currency where available, or in GBP.

5.4 Cancellation & Refunds

You may cancel your Pro subscription at any time through the billing management page. Upon cancellation:

• You will retain access to Pro features until the end of your current billing period
• Your alliance will revert to the free tier at the end of the billing period
• No refunds are provided for unused portions of a billing period
• Data associated with Pro-only features will be retained but inaccessible until you resubscribe

5.5 Your Statutory Rights (UK Consumers)

If you are a consumer in the United Kingdom, you have statutory rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. For digital services purchased online, you have a 14-day cooling-off period from the date of purchase during which you may cancel for any reason.

If you request that we begin providing the Service immediately (before the 14-day cooling-off period ends), you acknowledge that you may lose your right to cancel once the Service has been fully performed. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

5.6 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle. Continued use after a price change constitutes acceptance of the new price.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe on the intellectual property or other rights of any third party
• Upload malicious content, viruses, or code designed to disrupt the Service
• Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure
• Scrape, crawl, or use automated tools to extract data from the Service without our written consent
• Reverse-engineer, decompile, or disassemble the Service
• Impersonate another person or entity
• Harass, threaten, or abuse other users
• Upload screenshots or images that contain personal information of individuals who have not consented to its processing
• Use the Service in any way that could damage, disable, or overburden our infrastructure
• Circumvent usage limits, rate limits, or feature restrictions
• Resell, sublicense, or commercially exploit the Service without our written consent

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these rules, including suspending or terminating their account.

7.1 Your Content

You retain ownership of any content you submit to the Service, including in-game data, guides, announcements, and uploaded screenshots ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and process that content solely for the purpose of providing and improving the Service.

7.2 Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not endorse or verify any User Content and are not liable for content submitted by users.

7.3 Content Removal

We may remove or disable access to any User Content that violates these Terms, without prior notice. If you leave an alliance or delete your account, your contributed data (such as event scores and rankings) may be retained in anonymised form for the benefit of the alliance.

The Service, including its design, code, features, and branding, is owned by Instance Labs LTD and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without our prior written consent.

All game names, characters, and related imagery from Last War: Survival are the property of FUNFLY PTE. LTD. and are used for identification purposes only.

The Service includes AI-powered features such as screenshot scanning that use machine learning to extract data from images. You acknowledge that:

• AI extraction may not be 100% accurate — you should verify extracted data before relying on it
• Uploaded images are processed by our AI provider and are not stored or used for model training
• AI features may be subject to usage limits and are available only on the Pro tier
• We are not liable for decisions made based on AI-extracted data

The Service integrates with third-party services including AWS, Stripe, and Google Analytics. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.

If you connect your Discord account or use Discord webhooks through the Service, your use of Discord is subject to Discord's own terms of service.

To the maximum extent permitted by law:

• No warranty. The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Limitation of damages. In no event shall Instance Labs LTD, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
• Liability cap. Our total aggregate liability for all claims arising from the Service shall not exceed the total amount you have paid us in the 12 months preceding the claim, or fifty pounds (£50), whichever is greater.
• Game outcomes. We are not responsible for in-game outcomes, alliance performance, or any consequences arising from use of the Service's coordination tools or data.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

You agree to indemnify and hold harmless Instance Labs LTD, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your User Content.

13.1 Termination by You

You may delete your account at any time by contacting us at legal@instancelabs.dev. If you have an active Pro subscription, cancellation of your account will also cancel your subscription at the end of the current billing period.

13.2 Termination by Us

We may suspend or terminate your account immediately and without prior notice if you:

• Violate these Terms, including the Acceptable Use provisions
• Engage in fraudulent, abusive, or illegal activity
• Attempt to hack, exploit, or compromise the security of the Service
• Fail to pay subscription fees when due
• Create multiple accounts to evade bans or restrictions
• Are inactive for an extended period (we will provide notice before deleting inactive accounts)

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will survive.

If you have a dispute with us, we encourage you to contact us first at legal@instancelabs.dev so we can try to resolve it informally. We will make reasonable efforts to resolve any dispute within 30 days.

If we are unable to resolve the dispute informally, either party may pursue the matter through the courts of England and Wales, subject to Section 15 below.

These Terms are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising from or relating to these Terms, except where you are a consumer residing in the European Union, in which case you may bring proceedings in your country of residence.

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Instance Labs LTD regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.5 Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date. For significant changes affecting your rights or obligations, we will provide at least 30 days' notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
